Terms of Use
Written by Pink Matter Ltd in plain English. Something unclear, or want to use one of your rights? Email hello@pink-matter.co.uk.
The plain-English rules for using the Learning Velocity Index™ app. Short version: your score is a useful, indicative signal, not a verdict; be straight with us and we will be straight with you.
1. Who we are and what this covers
These terms apply to your use of the Learning Velocity Index™ app at app.learningvelocityindex.com and the marketing site at learningvelocityindex.com (together, the “Service”). The Service is provided by PINK MATTER LTD, a company registered in Scotland, company number SC870294 (“Pink Matter”, “we”, “us”). By using the Service you agree to these terms. If you do not agree, please do not use it.
2. The assessment and your score
The Learning Velocity Index™ (LVI) assessment is a self-reported instrument. Your score, band and sector comparisons are indicative: they reflect the answers you (and any colleagues you invite) give, compared with our sector comparison data. They are not an audit, a guarantee of results, or professional, legal, financial or HR advice, and you should not rely on them as the sole basis for a decision.
Sector comparisons are provisional and are not drawn from a validated sample. We may improve the scoring method and sector comparisons over time, so scores can change between versions.
3. Your account
- Give accurate information and keep your sign-in details secure. You are responsible for activity under your account.
- The assessment is for working professionals aged 18 or over. We do not knowingly collect children’s data. Use it for work, or with your employer’s permission to answer on its behalf.
- You can delete your account at any time from the Account page. See our Privacy Policy for what happens to your data.
4. Acceptable use
Please do not:
- submit false, misleading or other people’s data without their permission (including colleagues’ email addresses you have no reason to share);
- attempt to game, scrape, reverse-engineer, overload or break into the Service;
- use the Service to build competing sector comparisons or to resell our scores or data;
- use the Service unlawfully, or to harass or mislead anyone.
5. Inviting colleagues, sharing and verification
If you invite colleagues to rate your organisation, you confirm you have a legitimate reason to contact them. If you create a share link, badge or verification link, the band it shows can be seen by anyone with the link, and you can revoke it from the app. You decide what you share.
6. Your data and ours
Your data: you keep ownership of what you submit. You give us permission to process it to run the Service, produce your results, and (in anonymous, aggregate form) to build sector comparisons and improve the index, as described in ourPrivacy Policy.
Ours: the Service, the scoring methodology, sector comparisons, reports, design and content belong to Pink Matter or our licensors. “Learning Velocity Index” and “LVI” are names Pink Matter uses for this Service. You may use your own results and reports internally and share them with your organisation, but may not present our methodology, sector comparisons or branding as your own.
7. Cost
The core assessment is free.
7A. Deep Report (£79): cancellation and refunds
What you buy. The Deep Report is digital content: a personalised report for one completed assessment, available in the app to the account that bought it. It is a one-off purchase, not a subscription, and nothing renews. A retake is a new assessment and has its own Deep Report. Your free score, results page and Board Scorecard stay free.
Who sells it. Pink Matter Ltd, a company registered in Scotland (company number SC870294). Registered office: 1 Stoneybank Drive, Musselburgh, Scotland, EH21 6TB. Email: hello@pink-matter.co.uk.
Price. £79, one-off. That is the total you pay: no VAT is charged. Payment is taken at checkout by our payment provider, Stripe.
Your 14-day right to cancel. If you buy as a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you 14 days, starting the day after you buy, to cancel a contract for digital content.
- The Deep Report is supplied straight away. Before checkout we ask you to tick a box confirming that you want it supplied immediately and that you understand you will lose your right to cancel once supply starts. We record when you gave that consent and confirm it in your purchase confirmation email. Once supply has started, the 14-day right to cancel no longer applies.
- If you did not give that consent and acknowledgement, or we did not send you that confirmation, you can cancel within 14 days of the day after you bought it and we will refund you in full.
If the Deep Report is faulty. Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described. If it is not, you can ask us to repair or replace it. If we cannot, or do not do so within a reasonable time and without significant inconvenience to you, you can ask for a price reduction, which can be up to a full refund. These rights apply whether or not you have lost the right to cancel.
How to ask. Email hello@pink-matter.co.uk from (or quoting) the email address on your account. Say that you want to cancel, or describe what is wrong, and include your Stripe receipt if you have it. We aim to reply within 5 working days. You can also contact Advice Direct Scotland (consumeradvice.scot) or Citizens Advice (England and Wales) for free advice.
Refunds. We refund within 14 days of receiving your cancellation, or of agreeing that a refund is due, to the original payment method. We do not charge a fee for this. When a purchase is fully refunded, access to that Deep Report ends. If a payment is disputed with your card issuer, we may suspend access while the dispute is open and will restore it if the dispute is resolved in our favour. A partial refund (for example a price reduction) does not end access.
Buying for a business. The 14-day cancellation right above is for consumers. If you buy for a business, it does not apply, but you keep any rights you have by law; if something is wrong with the Deep Report, tell us and we will put it right or refund you where the Deep Report is not as described.
No guarantee of outcomes. Like your free score (section 2), the Deep Report is based on self-reported answers and is indicative. It suggests where to focus; it does not guarantee any particular result.
8. Availability and changes
We work to keep the Service available but do not promise it will be uninterrupted or error-free. We may change, suspend or withdraw features, and may update these terms; if a change is material we will tell you in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
9. Our responsibility to you
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Subject to that, the Service is provided “as is”, and we are not liable for indirect or consequential loss, loss of profit, or decisions made in reliance on an indicative score. Our total liability for any claim relating to the free Service is limited to £100; for a paid plan, to the fees you paid in the 12 months before the claim.
10. Ending your use
You can stop using the Service and delete your account at any time. We may suspend or end access if you breach these terms or misuse the Service. Sections that by their nature should survive (such as ownership and liability) will continue to apply.
11. Governing law
These terms are governed by the laws of Scotland, and the Scottish courts have jurisdiction, except that if you are a consumer you keep any mandatory rights you have in your home country.
12. Contact
Questions about these terms: emailhello@pink-matter.co.uk; we will reply as soon as we can.
